The clear language of the regulation says that you must be in valid H status when leaving in order to return in that status. Unfortunately, this doesn't apply to your wife.

A friend of mine got an RFE (asking for employment letter) on his I485 yesterday. Does that mean they are working on his case? His priority date is later than mine and I dont hear anything from them!

I got the LUD on the same date (Soft LUD) but didn't call to check on the status.

here is what uscis says about lud
* Note on "Last Updated" date:
Your case may have a new "Last Updated" date and you may receive an Email Notification of your case being updated, without the status of the case changing. This is due to internal USCIS processing being performed on your Case. This will be reflected in the "Last Updated" date, but may not result in a different status message
For all the folks who have done FP and have received their EADs, did anyone ofyou got any LUDS on your AP case since the receitp date. If so, please let us know how many LUDS and how often you go them.

Once a I140 is filed without the I485 one has to wait for I140 approval before being eigible for filing I485
Can you post any supporting documentation for this?

Hey here is a situation:
I have over 7 years of experience in IT
Come with a 4 year bachelor and 2 year masters from India from a non-computers background.
Have a diploma (1 year in computers)
few other computer certificate courses.
I work for Fortune's Best software company as sr. software qa engineer. My company wants to go ahead filing for my GC.
My company attorney says am not eligbile for EB2 based on the above but eligible for EB3. I am confused because I already have an EB2 being filed for future employment from a small company.
So I kind of guessing my company attorney's want to play safe to be on EB3 rather than EB2.
So what do u guys think that my company attorney is correct.
My understanding is that with the above qualifications, I am eligible for EB2.
Am I wrong????

1) I got my first H-1 on 10/01/2006 ( I-29 date). When is the latest I should renew my H-1B visa
Answer: At least three months before your H1 expires.
2) I was a July filer and my wife is already using EAD (business). Does it make sense to renew her H-4 as well
Answer: No.. She is already doing business, which she can not if she goes back on H4. If she is making money then no point going for H4.
3) I was going to apply for AP for my wife? Will I loose my H-1 if I apply AP for myself too
Answer: As the previous member said, both are separate issue, so don't worry and just apply for her AP.
My two cent: You should apply for your EAD and AP as well...

Shustermann says that today ist the last day that all the employment- based-preference categories are current (exception unskilled workers). Ok, now he sasy : We recommand that Employers and their attorneys e-filing their I-140 today.
Please explain me if thats so important to file today the I-140 becouse just today the priority date are current.
I dont understand whats has the filing form I-140 to do with the priority Dates. Priority date is the PERM date??

yes, the I-140 is also for NIW cases, but remember that your priority date is not "fixed" unless you have an approved I-140 backing up that petition.
What Shusterman is saying is that file the I-140 today and get receipt notice (number) and then based on the priority dates being current only till today you will be able to file the I-485 before Aug 17th.
